Decembers helps you record your life story — the people, places, dates, and feelings that made it — and share it with the people closest to you. This policy explains what information we collect, how we use it, and the choices you have. It applies to Decembers users in the United States.

HyThere Corp is the company responsible for processing your information under this policy (sometimes called the “data controller”). You can reach us at decembers@hythere.co or HyThere Corp, 2800 Irving Ave S, Minneapolis, MN 55408.

1. Information We Collect

From sign-in: When you create an account, we get your name and email address from your sign-in provider (like Google).

Profile information:

  • Birth year and birthplace, which personalize your timeline and appear on your Portrait cover

Your memories: Decembers is built around the things you choose to record, including:

  • Written answers, voice recordings, photos, and videos
  • The dates, locations, and people connected to each memory
  • The feelings or mood you attach to a memory (e.g., “peaceful,” “grieving,” “complicated”)
  • The privacy setting you choose for each entry (just you, or your Inner Circle)

Some memories may include details about your own health or a loved one’s health — a diagnosis, an illness, a recovery. Recording this kind of detail is entirely your choice; Decembers never requires it. Health-related information you choose to share is protected the same way as the rest of your memories, and in some states carries additional legal protections — see “Law Enforcement and Legal Requests” below.

Inner Circle contacts: When you invite someone into your Inner Circle, we collect the email address or phone number you provide so we can send the invitation. Depending on how you’ve shared it, an invitee may view your Portrait through a secure private link, by creating their own free Decembers account, or both — see our Terms of Service for how Inner Circle access works.

Voices: You can invite someone else — a “Voice” — who was part of a specific memory to add their own perspective to it. When you do, we collect the email address or phone number you provide to send that invitation, along with whatever the Voice chooses to contribute (their written answer, recording, or photo). A Voice’s contribution becomes part of that memory and follows the same privacy setting you’ve chosen for it.

Legacy Contacts (coming soon): We’re building a feature that will let you optionally designate one or more Legacy Contacts — people you choose to be granted access to your account if you pass away. Once available, if you designate a Legacy Contact, we’ll collect the email address or phone number you provide so we can identify and reach them if we receive and verify proof of your death. See our Terms of Service for how this feature is designed to work.

Collected automatically:

  • IP address and general device/browser information
  • How you use the app (features used, pages visited)
  • Cookies, local storage, and similar technologies, which keep you signed in, remember your preferences, and let us run basic analytics on how Decembers is used. We don’t use cookies or similar technologies for third-party advertising or cross-site tracking.

2. How We Use Your Information

We use your information to:

  • Create and run your account
  • Build your Lists and generate your Portrait
  • Personalize your experience (e.g., using your birth year to surface relevant world events)
  • Deliver invitations to the people you add to your Inner Circle
  • Send you service updates and, if you opt in, product emails
  • Respond to support requests
  • Keep the product secure
  • Comply with the law

3. How We Use AI

Decembers uses AI to power specific features — generating your Portrait from what you’ve recorded, suggesting memory-jogging prompts, and summarizing memories. This section explains how, and what we don’t do.

3.1 What AI does in Decembers

  • Portrait generation — assembling what you’ve recorded into your Portrait.
  • Memory joggers — suggesting prompts based on what you’ve already shared, to help surface additional memories.
  • Memory summaries — condensing what you’ve recorded into a shorter summary.

3.2 We don’t train AI models on your memories

We do not use your personal memories — your written answers, recordings, photos, videos, or any other Content — to train general-purpose AI models, ours or anyone else’s, without your explicit permission. In practice, that means:

  • We don’t train our own AI models on your Content.
  • We use third-party AI providers to power the features above, under agreements that prohibit those providers from using your Content to train their own models.
  • Your Content isn’t used to improve AI products beyond generating your own Portrait, joggers, and summaries for you.

3.3 Third-party AI providers

To power these features, we send relevant Content to third-party AI providers strictly to generate the output you’ve requested — for example, sending your recorded answers to generate your Portrait. These providers are bound by agreements limiting their use of your data to providing that service to us, and prohibiting them from retaining your data to train their own models.

4. How We Share Information

We don’t sell your information — not to advertisers, data brokers, or anyone else.

Your memories and Portrait are private by default. We share information only in these ways:

  • Your Inner Circle — People you’ve specifically invited can see your published Portrait and any entries you’ve marked visible to them, through a secure private link, a Decembers account, or both, depending on how access is set up. See our Terms of Service for how Inner Circle access works.
  • Voices you invite — Someone you invite to contribute their perspective to a memory sees only that specific memory, not your full Lists or Portrait.
  • Your designated Legacy Contact (coming soon) — Once this feature is available, if you’ve designated a Legacy Contact and we’ve received and verified proof of your death, we’ll grant them access to your account at the level you selected. See our Terms of Service for details.
  • Service providers who help us run Decembers — including hosting, email delivery, payments, and the third-party AI providers described above — under agreements that limit how they can use your data.
  • Law enforcement or regulators, only as described in “Law Enforcement and Legal Requests” below.
  • A buyer or successor, if Decembers is acquired or merged — your information would transfer as part of that deal.

5. Law Enforcement and Legal Requests

We only disclose your information to law enforcement or other government authorities in response to valid legal process — for example, a subpoena, court order, or warrant — appropriate to the type of information being requested. Some categories of information, including health-related details you’ve chosen to share in a memory, may be protected under state consumer health data laws (such as Washington’s My Health My Data Act or Nevada’s consumer health data law) and may require a warrant or other heightened legal process before we can disclose them, regardless of the type of request we initially receive.

When we receive a legal request, we review it to confirm it’s valid and we push back on or narrow requests that are overbroad, producing only what’s specifically required. Unless we’re legally prohibited from doing so (for example, by a court-ordered non-disclosure requirement) or believe there’s an imminent risk to someone’s safety, we’ll notify you before disclosing your information so you have the opportunity to respond.

We don’t proactively share your memories, Portrait, or Inner Circle information with law enforcement absent a valid legal request.

6. Security

  • Your data is encrypted both in transit and at rest.
  • Especially sensitive details — your phone number, birthplace, and birth date — get an extra layer of encryption.
  • Your data is stored on servers in the United States.
  • Only people you’ve invited into your Inner Circle can see the parts of your record you’ve chosen to share with them.
  • No system is 100% secure, but we build Decembers with the same security standards used across HyThere Corp’s broader platform.

7. Data Retention

We keep your information for as long as your account is active. If you delete your account, we remove your Lists, your Portrait, and your Inner Circle connections. Some information may be kept briefly afterward where needed for legal, security, or accounting reasons.

If a Voice has contributed their perspective to one of your memories, deleting your account or that memory also removes the Voice’s contribution — it doesn’t persist separately from the memory it was added to. See our Terms of Service for how Voice contributions are handled, including how a Voice can ask to have their own contribution removed.

8. Your Choices and Rights

You can:

  • Ask what personal information we have about you, and request a copy of everything you’ve recorded
  • Export your Lists and Portrait as a PDF at any time
  • Ask us to correct inaccurate information
  • Delete your account at any time from Account settings — this permanently removes your Lists, your Portrait, and every Inner Circle connection
  • Change the privacy setting on any memory at any time (just you, or your Inner Circle)
  • Opt out of marketing emails (unsubscribe link in every email)

If you’re a resident of a state with its own privacy law (such as California, Colorado, Connecticut, Virginia, Washington, Nevada, or others), you may have additional rights under that law, including specific rights related to health data. To exercise any of these rights, email decembers@hythere.co. We’ll ask you to verify your identity before making changes.

9. Children’s Privacy

Decembers is not directed at children. We don’t knowingly collect personal information from anyone under 13.

11. Changes to This Policy

We may update this policy from time to time. If we make material changes, we’ll post the update here and change the “Last updated” date above.
